Current restitution status

Rejected request
: On 2 February 2015 the Restitutions Committee advised the Minister of Education, Culture and Science to reject a claim to this painting. The minister rejected the claim.

Research findings

Who owned this painting before it passed to Nederlands Beheersinstituut is not known.

The painting may have been part of property confiscated from Germans after the war. In 1947, the Winterswijk representatives at Nederlands Beheersinstituut's Bureau Roerende Goederen van Vijanden en Landverraders passed various paintings on to Stichting Nederlands Kunstbezit. Reference is made in the correspondence regarding this transfer to two paintings titled Herberg (Tavern) and Boerenherberg (Country Traven). One of these titles may refer to this work. Inscribed in black ink on the reverse of the frame is the name: Van Ostade. In blue chalk: 'Haarlem, Walt…, Wil…plein 7'. In red chalk: 'Fleij' or 'Heij'. This may refer to Wilsonplein 7 in Haarlem. Investigation has shown that this was where Juda Heijman de Vries (12 September 1900-12 May 1943 Sobibor), a Jewish tailor, went into hiding. There are no other indications to suggest that Heijman de Vries owned this painting.
